PRIVACY POLICY FOR REGISTERED FUNDINFO.COM AND ETFINFO.COM USERS

 1. Introduction

This Privacy Policy describes how FE fundinfo (Switzerland) AG (“fundinfo”) collects, uses and handles  registered user information. It further describes why we collect information, how we use cookies and IP addresses, when and how we share personal information with third parties and how we keep your personal information secure.

The terms “we” “us” and “our” refer to FE fundinfo (Switzerland) AG, FE fundinfo (UK) Ltd, FE fundinfo (Germany) GmbH, FE fundinfo (Hong Kong) Limited, FE fundinfo (Spain) S.L., Madrid, FE fundinfo (Singapore) Pte Ltd and FE fundinfo (France) SAS.

“fundinfo website” or “fundinfo” refers to both fundinfo.com and etfinfo.com.

“ individual user” refers to registered individuals accessing fundinfo’s websites.

“business users” refers to registered businesses accessing fundinfo’s websites.

Additionally, when you use our services, we will collect your IP address. fundinfo will differentiate between individual users and business users based on the source IP address. For business users only, we will directly collect metrics (visit timestamps, count of pageviews, count of visits, visit durations), and dimensions (URL viewed, device type, browser). Also for the business users, through Lead Forensics (a third party), we will indirectly collect additional dimensions (company name; company registered address(es), country, county, postal code; company website address and telephone number; industry and SIC (Standard Industry Classification Code); published AUM and /or turnover (if listed); number of employees; company registration number and year of founding).

 

 5. Why do we collect information and how do we use it?

a) in general

fundinfo collects personal and non-personal information to enable us to provide information and documents to you, to decide how to develop our products, to create commercial opportunity for selling insight to asset managers, as well as to provide information to our members, who are the fund managers and companies listed in the members section of the fundinfo website.

If you create an account with fundinfo and request to be informed by e-mail about the availability of new documents on the fundinfo website, we will provide information to each individual member about which documents you request, the language you have requested them in and the funds to which these documents relate.

We also use your personal information to perform marketing and research related activities and to supply other administrative services (e.g. the setting up of user accounts should you choose to set up an account). In addition, we may from time to time review your usage of the site in order to assess how we can improve our services.

b) Specific to Digital Advisor

fundinfo’ Digital-Advisor collects personal information to enable us to set up your account properly, to decide how to develop our products, to create commercial opportunity for selling insight to asset managers, and for quality assurance, and for legal reasons:

Set up of your account: your company / organisation may have expressed some preferences in the set up. Therefore, to access these settings and to share information within your organisation we may link your account to your company / organisation.

Quality assurance and product development: we evaluate the timestamp of your fund searches with the number of funds that have resulted from your search. Whenever you generate a fund list, we evaluate the timestamp as well as the name and language of the template. We collect this information to track whether you still have access to the tool, use it from time to time and do not get back zero results all too often. We will occasionally contact you to inform you about the benefits and new features of the Digital-Advisor or to train you in its use.

Legal reasons: we archive the content of each of your search and its result and we archive each fund list you generate. We do this only to have these details available should you request them, in case of a legal dispute or of requests from supervisory bodies or auditors. This archive is only accessible to our compliance department. Obviously, we also have to store your fund ratings and your fund comments for your use. Only our compliance department has the permission to access this information on your request, in case of a legal dispute or of requests from supervisory bodies or auditors.

The data collected is being stored securely in fundinfo’s databases. The information is further processed by fundinfo to achieve the purposes mentioned above.

 6. Lawful basis for processing your personal data

fundinfo will process your data in a lawful, fair and transparent manner.

Your personal and non-personal data is processed because you have consented to the processing of your personal and non-personal data for the purpose of using the services provided by fundinfo.

 7. How long do we hold your information for?

Your personal data is collected and held by fundinfo:

once the account has been closed, any data retention will only be to the extent necessary for us to comply with our legal obligations, enforce our agreements, internal analysis purposes or to improve website functionality.

The business users metrics and dimensions (non-personal data) are being retained for a year. The business users IP addresses (non-personal data) are being retained by Lead Forensics according to their own data retention policy.

 8. How do we collect information?

We collect personal information when you specify your country of residence and investor profile (whether you are a private investor or an institutional investor) through the use of cookies. We collect further personal information and your consent to use your information when you register for a user account with fundinfo through the use of a registration form. We also collect further personal information through reviewing how you use our site. We will also record the acceptance of the privacy policy.

Every time you connect to our websites, we will identify your source IP address and we will use technologies from Lead Forensics to establish whether you are an individual user or a business user. Individual users IP addresses (personal or dynamic) are being discarded immediately and not processed any further by Lead Forensics.

 9. Cookies

a) in general

A cookie is a small file which a website puts on a computer or other device so that the website can remember something about you at a later time. When you visit the fundinfo website for the first time, you will be asked to specify your country of residence and investor profile (whether you are a private investor or an institutional investor).  The fundinfo website will place a cookie on your computer or device so that when you visit the website again you will not be again requested to specify your country of residence or investor profile. fundinfo requires to use cookies to enhance its website functionalities by tailoring its services for you based, for example, on your investor profile and domicile.

The following are the cookie types we use:

-          Usage statistics.

These cookies will not be used for any purposes other than the ones stated above. The cookies we used are “essential”: this means that our cookies are strictly necessary for us to provide you with the service that you have consented to when accessing our website. As such, we do not provide for a mechanism of “opting-out”. If you do not accept our cookies you will not be able to avail of the services offered by fundinfo.com.

 10. Sharing of personal information with third parties

A) in general

If you create an account with fundinfo we will share your personal information, including your name and e-mail address, with our members. We will also share with each individual member the names and ISIN codes of the funds you have added to the MyFunds section of the fundinfo website, the country where you reside, the language through which you choose to access the fundinfo website and whether you are an institutional or private investor. fundinfo requires contractual undertakings from its members to keep your personal information confidential. In addition, we will share your personal information with our related companies FE fundinfo (UK) Ltd, FE fundinfo (Germany) GmbH, FE fundinfo (Hong Kong) Limited, FE fundinfo (Spain) S.L., Madrid, FE fundinfo (Singapore) Pte Ltd and FE fundinfo (France) SAS. We will share your IP address with Lead Forensics to identify business users, personal/dynamic IP addresses will be discarded immediately by Lead Forensics. We may also share your personal information where expressly authorized to do so by you or where such disclosure is required by the applicable law. In some instances, third party service providers may have access to your personal information when they perform certain contractually specified services for us. In such circumstances fundinfo requires contractual undertakings from these third parties to keep your personal information confidential.

B) Specific to Digital-Advisor

We do not share your personal information with third parties except where expressly authorized to do so by you or where such disclosure is required by the applicable law. In some instances, third party service providers may have access to your personal information when they perform certain contractually specified services for us. In such circumstances fundinfo requires contractual undertakings from these third parties to keep your personal information confidential.

fundinfo may provide links to one or more other third party web-sites. We encourage you to read their individual privacy policies before providing any of your personal information to them.

fundinfo is not responsible for the privacy policy adopted by third party web-sites.

12 Children’s data

fundinfo is intended for use by persons aged 18 and over. fundinfo does not knowingly collect or solicit any information from anyone under the age of 18. The services offered by fundinfo and its content are not directed at children under the age of 18. In the event that we learn that we have collected personal information from a child under age 18, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 18, please contact us.

 13. Your rights under Privacy Law

Your rights include:

 14. Transfers to third country jurisdictions

The fundinfo group is headquartered in Switzerland, with subsidiaries located outside the European Economic Area (EEA), in Singapore and Hong Kong. The European Commission has recognised Switzerland as providing an adequate level of protection of personal data. Your personal data may be transferred across international borders. It may be transferred to countries that have different levels of data protection laws to the country from where you submitted your personal data. fundinfo has put in place security measures for the export of personal data from its jurisdiction and has made arrangements with entities receiving your personal data such as, that they shall ensure that security measures are in place, and that your personal data is processed only in accordance with EU Data Protection laws.

 15. Security of your personal information

fundinfo takes reasonable measures to ensure the security of your personal information. In particular we take steps to protect against unauthorised access to disclosure of or alteration of your personal information. The steps we take to protect the security of your personal information include the putting in place of industry standard firewalls and password protection systems.
